The police of Kushinagar district of Uttar Pradesh has done an amazing feat. A unique eye-opening case came to light in the police investigation in Allahabad High Court. In this, after an FIR was lodged by a person named Shabd Prakash three years after his death, the statement of that person was also recorded by the police investigation officer of Kushinagar and a charge sheet was filed.
The matter did not stop here, the ‘ghost’ of the plaintiff Shabd Prakash also found signatures on the Vakalatnama on 19 December 2023 in the petition filed in the High Court. When this matter came up in the bench of Justice Saurabh Shyam of Allahabad High Court, then this thing came to light. Justice Saurabh Shyam was also surprised to see the case and he asked how did the police take the statement of a man who died three years ago?

The High Court commented on the Kushinagar Police and said that I am surprised by the facts of this case. How does the police investigate a crime? The police recorded the statement of a man who died three years ago. How could this have been done? The court directed the SP Kushinagar that a ‘ghost’ is harassing innocent people here. He is getting his statement recorded by the investigation officer. Investigate such investigation officers and submit a report.
Also, the High Court cancelled the proceedings of the criminal case. The court asked the High Court Bar Association to teach the plaintiff’s lawyer to be careful in future in this case.
This strange case is related to the complainant Shabd Prakash, who died on 19 December 2011. An FIR was registered in Kushinagar’s Kotwali Hata in 2014. The plaintiff in this was Shabd Prakash, and 4 people including Purushottam were made accused. Sections of fraud, forging documents and threatening were imposed. After investigation, the investigator filed a charge sheet on 23 November 2014. After this, the four including Purushottam filed an appeal in the High Court to cancel the charge sheet. They challenged the case saying that the whole case is fake, which was also supported in the report of CJM Kushinagar. He gave the report on the basis of the statement of the deceased’s wife and the death certificate. The lawyer told the court that how can a dead person file a case. The death certificate was presented as evidence. The four had appealed in the High Court to cancel the charge sheet, after which this matter came to light.
